Dish to pay TiVo $104 million after court ruling

Dish Network Corp and EchoStar Corp will pay $104 million in damages to TiVo Inc after the U.S. Supreme Court on Monday denied Dish’s appeal of a patent infringement case.
The court’s decision not to review an appellate court’s ruling follows years of legal wrangling over TiVo’s “Time Warp” software that allows users to record one television program while watching another via a digital video recorder.

“Because of the Supreme Court’s decision, we will pay Tivo approximately $104 million (the amount the jury awarded in 2006 plus interest),” Dish said in a statement. “The money is in an escrow account and will be released to Tivo in the next few days.”

Still to be determined is how U.S. District Judge David Folsom in Texas will rule on whether EchoStar owes TiVo more damages for allegedly failing to turn off its DVRs, as required in the injunction.

EchoStar, instead, continued collecting subscription fees for the infringing DVRs and replaced the infringing software with a “work-around” that does not use TiVo’s patented technology.

“Judge Folsom has to determine how to treat these workarounds,” said Jand Partners analyst Murray Arenson. “Today’s ruling doesn’t change anything — the bigger issue is this injunction. That determines whether EchoStar is backed into a corner or not.”

TiVo, in a statement, said it was looking forward to receiving the award, and is confident a lower court will enforce the injunction against Dish, which operates the No. 2 U.S. satellite television service.

Dish, in a statement, disagreed.

“We believe that the design-around does not infringe Tivo’s patent and that TiVo’s pending motion for contempt should be denied,” Dish said.

Dish, formerly known as EchoStar Communications Corp, recently spun off its technology assets, including its set-top box division, to create EchoStar Holding Corp.

On Nasdaq, TiVo fell 13 cents, or 2.08 percent, to $6.13; and Dish dropped $1.30, or 6.9 percent to $17.50 at mid-afternoon.

PluggedIn: EA’s Spore aims to create new worlds, businesses

Electronic Arts Inc’s creature-building game “Spore” offers players a chance to develop new worlds — and maybe even new lines of business for the video game maker.The new game, which lets players guide the evolution of their creatures, is from Will Wright, the man behind the Sims series of games. The Sims let players guide virtual people and cities, spawning spin-offs, sequels and expansion packs to the tune of more than 100 million units sold worldwide.

Billy Pidgeon, video game analyst for IDC, believes “Spore” is a going to be huge globally, eventually eclipsing the Sims.

“This title has billion-dollar potential,” he said. He expects spin-off games and a host of fan-oriented websites and products, such as custom T-shirts of players’ creatures, that should boost the value of the game.

Already players trying out early releases are sharing their creatures, adding complexity to the game at no expense to EA.

Gamers have been waiting five years to get their hands on “Spore”, which will finally launch in North America on Sept. 7, and EA has spent $50 million to develop it, estimated Michael Pachter, video game analyst for Wedbush Morgan Securities.

Pachter estimates EA will ship 3 million copies of “Spore” at $120 million wholesale, and expects it to sell through 2 million this year. With a break-even point of 1.7 million units, EA should be well on its way to a strong new franchise.

“Economically, it’s not that big of a deal this year, since it cost so much to make, but they made a big bet that this game would pay dividends for years, so they care a lot,” he said.

REAL CASH FROM VIRTUAL WORLD

EA CEO John Riccitiello said at a Citigroup conference in New York that the “microtransaction potential for ‘Spore’ is huge,” referring to selling gamers new virtual creature parts, vehicles and even planets online for real cash.

Creator Wright calls Spore the world’s first “massively single-player” experience because every new “Spore” creation can be uploaded to EA databanks and then used to populate other players’ game worlds. Wright said one of the next challenges is how EA can we make the most of gamers’ creations.

EA gave a taste of the game with the June 17 release of “Spore Creature Creator”, a $10 mini-game that has led to the building of 3.3 million creations uploaded to Spore.com.

Of course evolution could hit a dead end.

“Obviously, gamers that waited this long for ‘Spore’ will probably love every second of it,” said Chris Buffa, senior editor at AOL GameDaily. “These are the people that’ll spend hours creating monsters and plundering space.

“That said, few games that take this long to make live up to the hype, and there’s a possibility that what these people think ‘Spore’ should be, based on all the hype, will fall way short of the final product.”

EA is offering an assortment of “Spore” choices, aiming for the largest audience possible. As well as the standard $50 PC game, “Spore Galactic Edition” ($80) comes with a poster, two documentaries on the game, a 128-page hardback book on the art of the game, a collectible case and a Galactic Handbook.

EA will tap the many users of Nintendo Co’s DS with “Spore Creatures” ($30), designed for the portable. Rounding out the launch options is “Spore Origins” for mobile devices, allowing for short spurts of creativity on-the-go. Console versions of Spore are expected in the future.

“Casual gamers will likely play ‘Spore’ in short bursts,” Buffa said. “It’s always a matter of whether they’ll ‘get it,’ since they’re used to more digestible games that aren’t as deep. As for the Sims fans, this is the next evolutionary step for Sim games.”

Spore has shipped in Australia, Germany, France, Belgium, the Netherlands, Luxembourg, Switzerland, Austria, Finland and expands to the rest of Europe and South America on Sept. 5.

Rear Surround speakers not loud enough = No true effect?

I connected all the speakers into the correct terminals. My receiver doesnt have Dolby Digital but Dolby Prologic. That meant it didnt have a digital audio output, so using RCA cables I connected between my DVD player using the Analog 5.1 ch output method which worked perfectly. The thing is that I cant hardly hear the rear surround speakers. I positioned the speakers perfectly, but still i cant hear no true Dolby movie effect. The speakers do work, but you have to go very close to hear the sounds which is quite stupid. Arent surround speakers supposed to be loud, coz mines not loud enough? My other home theatre system downstairs has a dolby digital receiver with 6.1 ch speakers hooked up with a blu ray but still has the same problem. Im thinking about connecting the surround speakers into the front speaker terminal.

 

Where did you place the speakers? Beside you, or behind you? Because the surround speakers are supposed to go on the sides of the room, not the back of the room. If there is a large distance from the speakers to your ears it is possible the surround speakers don’t go loud enough for you to hear them, though in my system they go plenty loud enough even in pro-logic.

There is also the fact that in many movies there is simply not a lot of sound going to the surround speakers. I would say somewhere between 95% and 99% of the time I hear nothing from my surround speakers at all. Since you say this happens in both Pro-Logic and Dolby Digital perhaps you are expecting something that just isn’t there in most movies.

There are settings on the receiver to adjust the volume of each speaker individually. As well as test tones to help you set the volume. If they work properly with the test tones there is not much you can do. If they do not work with the test tone you could have a wiring problem.

A cheap way to test them is to look for a movie that features a THX optimizer. It has tests for both audio and video. If not then you need to buy a calibration DVD such as Avia or Digital Video Essentials.

I would not suggest you hook up the surround speakers to the front channels. That would place a heavy load (low impedance) on the amp and you would risk blowing your outputs. However what you can do is choose the multi-stereo mode which sends the same sound to all the speakers.

BTW only Dolby Digital will give you true surround sound. Pro-logic gives you only a poor surround sound effect. also are you sure you have the receivers set to the proper mode? There should be an auto mode which will select the proper mode automatically, at least on the Dolby Digital receiver. You may have to choose the mode on the Pro-logic receiver manually.

The quality “radio buttons” are confusing. If you click on “High,” “Standard” goes to boldface and underlined, and vice versa. I can’t tell which is which by listening because the song always changes when you switch quality levels. Is the level in boldface and underlined the active quality level?

 

Yes It Is A Little Confusing. The lever that is not boldfaced and underlined is the active quality level. I Think it should be the other way around but thats how it is.
